These Terms of Use ("Terms") govern your access to and use of the Force7 eKatalog platform ("Platform") , owned and operated by Force7 Labs Pte Ltd ("Force7", "we", "us", "our")
These Terms should be read together with our Privacy Policy and User Level Consent Agreement (ULCA) , both of which form an integral part of these Terms. By accessing or using the Platform, you ("User", "you") agree to be bound by all three documents.
1.ACCEPTANCE OF TERMS
1.1 By accessing the Platform (via link, QR code, or any other medium), you:
• Acknowledge that you have read and understood these Terms, the Privacy Policy, and the ULCA
• Agree to comply with these Terms and applicable laws
1.2 If you do not agree to any of these documents, you should not use the Platform.
1.3 You represent and warrant that you are at least 18 years of age (or the age of majority in your jurisdiction). The Platform is not intended for children under 18.
The Platform is designed to:
• Provide product information, specifications, and content
• Enable users to explore pricing and financing options (including EMI simulations)
• Support interaction with authorised sales representatives
• Deliver a personalised browsing experience
You may use the Platform solely for:
• Personal, informational, and non-commercial purposes
• Evaluating products and services
• Engaging with authorised sales representatives
You shall not:
• Use the Platform for unlawful or fraudulent purposes
• Attempt to interfere with, disrupt, or compromise the Platform or its security
• Copy, reproduce, distribute, or scrape content without our prior written permission
• Misrepresent your identity or provide false information
• Attempt to reverse-engineer, decompile, or extract the source code of any part of the Platform
• Use any automated system (including bots or scrapers) to access the Platform
5.1 Product information, specifications, pricing, and financing illustrations (including EMI calculations):
• Are provided for general informational purposes only
• Are illustrative and do not constitute a binding offer or guarantee
• May vary based on actual terms, availability, eligibility, or lender approval
5.2 Force7 does not guarantee or warrant:
• The accuracy, completeness, or real-time updates of any information on the Platform
• Final pricing, loan approval, or financing terms, which are subject to dealer confirmation and lender approval
5.3 You acknowledge that:
• Images and descriptions are for illustration purposes only and may not reflect the exact product
• You should independently verify all details with authorised dealers or financing partners before making any purchase or commitment
6.1 The Platform may provide:
• Personalised product recommendations
• Tailored content and browsing experiences
6.2 Such personalisation is based on:
• Your interactions and preferences as described in our Privacy Policy and ULCA
• Behavioural data, device information, and engagement analytics
6.3 Personalisation is a core feature of the Platform. If you do not wish to have your data used for personalisation, please do not use the Platform or withdraw consent as described in the Privacy Policy.
7.1 Your use of the Platform is subject to:
• Our Privacy Policy, which explains how we collect, use, and protect your data
• Our User Level Consent Agreement (ULCA) , which governs your consent to data processing and tracking
7.2 By using the Platform, you acknowledge and agree that:
• Your interaction with the Platform may be analysed to improve your experience
• Data may be used for personalisation, analytics, and sales engagement as described in the ULCA and Privacy Policy
8.1 The Platform may include links to:
• Dealer websites
• Financing institutions
• External services or tools
8.2 Force7 is not responsible for:
• The content, accuracy, or availability of third-party services
• The privacy practices, terms, or policies of third parties
8.3 Your interactions with third-party services are governed solely by their own terms and policies. We encourage you to review them before proceeding.
The Platform may be accessed globally. By using the Platform, you acknowledge that your personal data may be processed, stored, and transferred across international borders as described in our Privacy Policy and ULCA. We implement appropriate safeguards to protect your data in accordance with applicable laws..
10.1 All content on the Platform, including:
• Text, images, graphics, and design
• Software, features, and underlying technology
• Product catalogs and specifications
are owned by Force7 or its licensors and are protected by intellectual property laws.
10.2 You are granted a limited, non-exclusive, non-transferable right to access and view the Platform for personal, non-commercial use. You shall not:
• Copy, reproduce, distribute, or create derivative works from Platform content
• Use content for commercial purposes without our prior written permission
11.1 Force7 may, at its sole discretion:
• Modify, update, or temporarily or permanently discontinue the Platform at any time without prior notice
• Restrict or suspend access to the Platform for maintenance, security, or other reasons
11.2 Force7 does not guarantee uninterrupted, error-free, or secure access to the Platform.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. FORCE7 MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
13.1 IN NO EVENT SHALL FORCE7 BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, BUSINESS, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF FORCE7 HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13.2 FORCE7'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED SGD 100.
13.3 THE FOREGOING LIMITATIONS SHALL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
You are solely responsible for:
• Verifying product details, pricing, and financing terms with authorised sellers or lenders before making any purchase or commitment
• Ensuring that your use of the Platform complies with applicable laws in your jurisdiction
You agree to indemnify, defend, and hold harmless Force7 and its officers, directors, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
• Your misuse of the Platform
• Your violation of these Terms, the Privacy Policy, or the ULCA
• Your violation of any applicable laws or third-party rights
Neither party shall be liable for any delay or failure to perform its obligations under these Terms (other than payment obligations) if such delay or failure arises from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, internet outages, or cyberattacks.
16.1 These Terms, the Privacy Policy, and the ULCA are governed by the laws of Singapore, without regard to its conflict of laws principles.
16.2 Any dispute arising out of or relating to these Terms or your use of the Platform shall first be referred to good faith negotiations between the parties. If the dispute cannot be resolved within 30 days, either party may submit the dispute to the courts of Singapore, which shall have exclusive jurisdiction.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the invalid provision shall be deemed modified to the minimum extent necessary to make it enforceable.
These Terms, together with the Privacy Policy and User Level Consent Agreement (ULCA), constitute the entire agreement between you and Force7 regarding your use of the Platform and supersede all prior or contemporaneous communications, whether written or oral.
Force7 may update these Terms from time to time. The "Last Updated" date at the top of these Terms indicates when changes were made. Continued use of the Platform after updates constitutes acceptance of the revised Terms. If you do not agree to any changes, you should stop using the Platform.
