These Terms of Use ("Terms") govern your access to and use of the Kampaign Application ("Application"), owned and operated by Force7 Labs Pte Ltd ("Force7", "we", "us", or "our"), a company incorporated in Singapore.

BY CLICKING THE "ACCEPT" BUTTON, LOGGING INTO, ACCESSING, OR OTHERWISE USING THE APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS, THE FORCE7 KAMPAIGN PRIVACY NOTICE, THE USER LEVEL CONSENT AGREEMENT (ULCA), AND ANY APPLICABLE POLICIES OF YOUR ORGANISATION.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE APPLICATION.

1.1 Authorised Users

The Application is intended solely for authorised users, including:

• Marketing personnel;

• Digital Marketing Managers;

• Brand Managers;

• Campaign Managers;

• Sales Managers;

• Business Development Managers;

• Regional Managers;

• Branch Managers;

• Senior Management;

• Executive Management;

• Administrators;

• Employees, contractors, consultants, or agents authorised by the Customer Organisation.

1.2 Permitted Use

You may use the Application solely for authorised business purposes, including:

• Creating and managing marketing campaigns;

• Monitoring active, paused, completed, cancelled, and scheduled campaigns;

• Monitoring campaign performance across digital and offline channels;

• Analysing campaign effectiveness;

• Measuring campaign return on investment (ROI);

• Tracking QR code-based marketing campaigns;

• Monitoring campaign budgets and expenditure;

• Reviewing campaign analytics and dashboards;

• Managing lead generation campaigns;

• Supporting marketing planning and decision-making.

1.3 You must not:

• Use the Application for personal or unauthorised purposes;

• Share login credentials with unauthorised persons;

• Access marketing information beyond your assigned permissions;

• Continue using the Application after your access has been revoked.

2.1 You are responsible for:

• Maintaining the confidentiality of your login credentials;

• Protecting your devices;

• All activities performed under your account;

• Logging out where appropriate;

• Immediately reporting suspected unauthorised access or security incidents.

2.2 Force7 may suspend or terminate access where misuse, security risks, fraud, or legal requirements arise

You agree to use the Application only in compliance with:

• Applicable laws and regulations;

• Your organisation's marketing policies;

• Force7's security, privacy, and acceptable use policies.

You shall:

• Maintain accurate campaign information;

• Record campaign budgets accurately;

• Maintain truthful campaign performance information;

• Protect confidential marketing information;

• Use reports solely for authorised business purposes.

You shall not:

• Copy, extract, or disclose campaign information outside authorised systems except where permitted;

• Manipulate campaign performance statistics;

• Falsify marketing reports;

• Modify campaign budgets without authorisation;

• Circumvent approval workflows;

• Attempt to reverse engineer, modify, or tamper with the Application;

• Introduce malware or malicious software;

• Access marketing information outside your assigned permissions;

• Use the Application for fraudulent, deceptive, unlawful, or unethical purposes.

5.DATA OWNERSHIP

5.1

All campaign information, marketing analytics, dashboards, campaign budgets, campaign assets, QR campaign information, lead attribution information, operational reports, forecasting information, AI-generated insights, and business intelligence remain the property of the Customer Organisation.

Force7 acts solely as the technology platform provider and does not claim ownership of such information.

5.2

Users acknowledge that campaign information, marketing strategy, customer segmentation, budgets, advertising performance, and ROI information constitute confidential commercial information.

5.3

Users must:

• Protect marketing information from unauthorised access;

• Secure exported reports;

• Protect campaign assets;

• Immediately report any suspected misuse or unauthorised disclosure.

The Application enables authorised users to:

• Compare campaign effectiveness;

• Monitor lead generation;

• Monitor customer engagement;

• Evaluate marketing spend;

• Optimise marketing investments.

Campaigns may include:

Digital Campaigns

• Google Ads;

• Facebook;

• Instagram;

• TikTok;

• LinkedIn;

• YouTube;

• X (formerly Twitter);

• Email campaigns;

• SMS campaigns;

• WhatsApp campaigns;

• Other supported digital platforms.

Offline Campaigns

• Print advertisements;

• Newspapers;

• Magazines;

• Billboards;

• Hoardings;

• Showroom branding;

• Shopping mall promotions;

• Events and exhibitions;

• Flyers and brochures;

• QR code campaigns;

• Other offline marketing channels.

The Application may generate:

• Campaign dashboards;

• ROI reports;

• Budget utilisation reports;

• Lead source analysis;

• Conversion reports;

• Cost-per-lead reports;

• Cost-per-acquisition reports;

• Campaign comparison reports;

• QR campaign reports;

• Marketing attribution reports;

• Executive dashboards;

• AI-generated marketing insights.

Reports are generated from information entered by users and integrated third-party platforms.

Force7 does not guarantee the accuracy of user-entered information or third-party platform data.

The Application may integrate with third-party platforms, including:

• Google Ads;

• Meta platforms (Facebook and Instagram);

• CRM systems;

• Analytics platforms;

• QR code services;

• Other supported advertising platforms.

Force7 is not responsible for:

• Availability of third-party platforms;

• Advertising platform policies;

• Changes made by third-party providers;

• Campaign delivery by external advertising services;

• Third-party reporting accuracy.

Your use of the Application is subject to:

• Force7 Kampaign Privacy Notice;

• Force7 Kampaign User Level Consent Agreement (ULCA);

• Applicable organisational privacy policies.

By using the Application, you consent to:

• Collection and processing of your Personal Data;

• Activity monitoring;

• Audit logging;

• Security monitoring;

• Generation of campaign analytics.

The Application may provide:

• Campaign optimisation recommendations;

• Budget allocation recommendations;

• Campaign health scores;

• Executive marketing dashboards.

These outputs are intended to support business decision-making and do not replace professional judgement.

All rights, title, and interest in the Application, including:

• Software;

• Source code;

• Dashboards;

• Reports;

• Documentation;

• AI functionality;

• Trademarks;

• User interfaces;

remain the exclusive property of Force7 or its licensors.

Nothing in these Terms grants ownership of Force7 intellectual property.

• modify or improve the Application;

• introduce new functionality;

• discontinue obsolete functionality;

• perform scheduled maintenance;

• restrict access where necessary for operational, security, or legal reasons.

Force7 does not guarantee uninterrupted availability or error-free operation.

Your use of the Application may involve the transfer or processing of Personal Data and Business Data across jurisdictions.
Force7 implements appropriate safeguards designed to protect such information in accordance with applicable data protection laws.

Force7 may suspend or terminate your access:

• if you violate these Terms;

• upon instruction from the Customer Organisation;

• for security or fraud prevention;

• following termination of employment or change of role;

• where required by law.

Upon termination:

• you must immediately cease using the Application;

• access credentials may be disabled;

• information may be retained or deleted in accordance with applicable law and the Privacy Notice.

15.DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

FORCE7 DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, CONTINUOUS AVAILABILITY, ERROR-FREE OPERATION, OR THAT THE APPLICATION WILL ACHIEVE ANY PARTICULAR MARKETING, SALES, LEAD GENERATION, OR BUSINESS OUTCOME.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Force7 shall not be liable for indirect, incidental, consequential, exemplary, or punitive damages;

• Force7 shall not be responsible for marketing decisions, campaign performance, advertising spend, conversion rates, lead quality, ROI, or business outcomes resulting from decisions made using the Application or AI-generated recommendations;

• Force7's total aggregate liability arising from these Terms or the use of the Application shall not exceed SGD 100.

You agree to indemnify, defend, and hold harmless Force7 against claims arising from:

• misuse of the Application;

• unauthorised disclosure of marketing information;

• manipulation of campaign information;

• breach of these Terms;

• violation of applicable laws or third-party rights.

Force7 agrees to indemnify you against claims arising from:

• Force7's gross negligence or wilful misconduct;

• Force7's breach of its obligations under the Privacy Notice;

• Force7's infringement of third-party intellectual property rights.

Neither party shall be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, cyberattacks, internet outages, telecommunications failures, governmental actions, or other force majeure events.

These Terms shall be governed by the laws of Singapore.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

Force7 may revise these Terms from time to time.

Material changes will be communicated through the Application or by email at least fourteen (14) days before taking effect, where practicable.

Continued use of the Application after the effective date of the revised Terms constitutes acceptance of those changes.

21.1 Entire Agreement: These Terms, together with the Privacy Notice and ULCA, constitute the entire agreement governing your use of the Application.

21.2 Severability: If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21.3 Waiver: No failure or delay by either party to enforce any provision shall constitute a waiver of that provision.

21.4 Assignment: You may not assign these Terms without Force7's prior written consent. Force7 may assign these Terms in connection with a merger, acquisition, restructuring, financing, or sale of substantially all of its business or assets.
